Order Process
 
  1. Contact us by phone or e-mail. (Local customers can setup an appointment to view our samples and ask questions).
  2. Choose a package or have your own custom montage created. Provide us with all your information about the montage. We will review your requirements and give you an estimated quote based upon our understanding, this quote will include all shipping costs and tax.
  3. Once you are happy with the quote.
    1. View the Planning Page
    2. Read the Customer Service Agreement
    3. Send your photos, music, video and all necessary information to us, the adress will be sent to you in an e-mail.
    4. Include full payment by check or money order. Make Check payable to "Janis Kam". (In person local orders require a 50% down payment at the start of the montage and 50% at the pickup time.)
  4. Once we receive your materials and payment we will send you an e-mail confirming we have recieved your order. Your montage will be created and sent to you within 2-4 weeks (along with any materials that you sent to us).
  5. We will keep your video-clip as well as your images on our system for seven calendar days. If you would like to order more copies during this time, then you can do so at the cost of 15.00 for each additional DVD. If you go over this time period, your cost will be 50.00 per additional DVD.

PhotoVideoTreasures - Customer Service Agreement

PhotoVideoTreasures agrees to work with the client to create a PhotoVideoMontage that meets their specifications. PhotoVideoTreasures agrees to incorporate the client's suggestions and ideas into the video. The client is to make all design and editorial suggestions before the creation of the video. After the client has received the video, changes can be made free of charge only (1) if PhotoVideoTreasures failed to meet the specifications given by the client prior to shipment (2) names, dates, quotes are incorrect according to the order form filled out by the client.

PhotoVideoTreasures reserves the right to eliminate photographs from the Montage due to music selections and timing. Photos considered to be obscene or offensive will be deleted. We also reserve the right to crop, color correct, or retouch any photograph used in the presentation to increase visual appeal. PhotoVideoTreasures is not responsible for photographs that appear to be slightly darker/lighter than the original prints, as specific colors may not appear to be the same on a television screen. All attempts will be made, however, to produce accurate representation of each photo.

The client is responsible for numbering each photograph for the purpose of specifying the order in which they are to appear. PhotoVideoTreasures will make every attempt to place the photos in the exact order requested, but does not guarantee the exact order specified. If no order is specified, PhotoVideoTreasures will attempt to categorize the photos chronologically. In this case, PhotoVideoTreasures is not responsible for photos that appear in the incorrect order. In the event that the incorrect information is included in the montage as a result of incorrect information provided in the order form (e.g. spelling etc.), it is the financial responsibility of the client to purchase an additional copy with the correct information (standard shipping applies).

The due performance of this agreement is subject to alteration or cancellation by PhotoVideoTreasures owing to any cause beyond their control. PhotoVideoTreasures takes the utmost care in respect to processing, designing, and shipping client's montages. Every care is taken in scanning, designing, and processing using professional materials. In the unlikely event of total technological failure, or any extenuating circumstances that prevent the video from being delivered on time PhotoVideoTreasures liability shall be limited to a full refund of all money paid for the event package. In the event that a video is damaged during the shipping process, PhotoVideoTreasures will ship a new video to the client (at no additional cost) upon the client's return of the damaged video. If you cannot play the DVD on your specific player (which is highly unlikely) then PhotoVideoTreasures will provide you with a copy on VHS.

Liability: Delivery of any photographic material/movie/video clip/tapes to us including electronic images for processing or any other purpose constitutes an agreement by you that if the material is damaged or lost by us, even though by negligence, or other fault, OR BY GOD'S ACT, we at PhotoVideoTresures are not responsible. Our handling of photographic material as well as electronic images and video clips, is without any warranty or liability. Every effort will be made to take care and protect your photographs, including the delivery of CD/DVD.

Copyright: You, the customer, are guaranteeing that no copyright infringements will take place as a result of the process you request, and that you will be responsible for any copyright infringements committed as a result of the service. Client warrants that the videotape, film, photos, slides or other media submitted to PhotoVideoTreasures for processing is not protected by a third party copyright owner or if protected, the client has obtained permission of such third party copyright holder to make copies. Client also agrees to protect and indemnify PhotoVideoTreasures from any costs related to copyright infringement.

The Copyright of all montages is retained by PhotoVideoTreasures. Reproduction by video or any other means is prohibited. Original files remain the property of PhotoVideoTreasures and may be used for advertising, display, or any other purpose seen appropriate. In return, PhotoVideoTreasures agrees to use the Montage in good faith and in good taste.

Music used in our PhotoVideoMontage is copyrighted material by which PhotoVideoTreasures does not hold copyrights. By submitting an order form and agreeing to PhotoVideoTreasures terms of service, clients agree that they have purchased and possess their own original copy of all music used in their video. You can avoid this by having us use royalty free music.

Professional portraits should not be submitted and will not be used unless permission has been obtained from the photographer. The photographer holds all copyrights to their images, and must agree to their use in your montage. Some photographers will agree to include their works when their name is attached. This is acceptable by PhotoVideoTreasures.

Payment: If the signing of this contract is in person, a retaining fee of half the package you chose is due at the time of the order and the other half will be due when you pickup your montage in person. The half payment of the retaining fee is a NON REFUNDABLE fee. It shall be liquidated damages to PhotoVideoTreasures in the event of a breach of contract by client. Full payment will be due on the agreement of the contract for orders over the phone, online or by e-mail . We begin production as soon as payment is received. Any bank charges incurred due to returned checks will be charged to the client along with a $50 insufficient funds fee. All personal checks must clear before montage is delivered with no exceptions. Payment is non-refundable.

It is mutually agreed that the above terms form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by PhotoVideoTreasures in writing.
